When we wrote this incident up for the calendar, we missed an important detail.
I don’t feel that bad, mind you — most of the news organizations that covered it did, too.
The calendar correctly said that Kissimmee deputies responded to a call for a burglary in progress: David Martinez-Estrada, 28, had illegally entered a home. When deputies arrived, he was still in the home, and he refused to come out for them.
But it helps to understand the dynamic when you know that the woman was the mother of Martinez-Estrada’s child. That’s the part we missed. He refused to come out until he “was able to see his baby.” (We don’t know how old the “baby” was.)
So Martinez-Estrada had broken into his ex’s home, refused to leave, and penetrated deeper into the home, finally forcing his way into the bedroom where his ex was. “With her family,” reports say — so it may be that he saw his baby after all.
It wasn’t a long visit, though: Deputies heard three shots, and before long Martinez-Estrada stumbled out of the home.
They took him to the ICU.
When he got out, he was charged with criminal mischief with damage over $200 but less than $1,000, unarmed burglary of a dwelling, following/harassing/cyberstalking another person, and resisting arrest without violence.
Based on everything I can see, the ex faced no charges.

Kudos to WESH 2 for picking up on the relationship between the “burglar” and the woman in the home. They’re the only ones who did — in fact, one of the other articles ends with the statement, “No additional information has been provided at this time, including why Martinez-Estrada was in the home to begin with.” It makes me wonder how they found the information, but they’re also the only outlet with an interview of the Sheriff.
