A little after five on a Sunday afternoon, 53-year-old Kevin Villalobos came up to the entrance of Ryan Fleming’s house, uninvited. The homeowner knew him — we don’t know in what capacity — but Villalobos was drunk and aggressive, and, among other things, he hit the resident in the head.

So the resident shot him.

Officers and medics tried to save him, but he died at the scene.

Nampa police called it “an isolated incident that started as a verbal dispute between known parties.”

The case went to the county prosecutor. This is routine, and it’s normal for these things to take a while to percolate. Six months later, Canyon County Prosecuting Attorney Christopher Boyd ruled that the resident had acted in self-defense under Idaho’s “Stand Your Ground” law; he declined to file charges.

Boyd’s statement opened with Villalobos’s family: “This was an unfortunate and tragic event that resulted in the loss of a life, and I extend my sympathies to the family of Mr. Villalobos as they grieve.”

Then he talked about the evidence that had been accumulated that supported the decision — witness statements, forensic analysis, physical and DNA evidence, and video footage — and said it showed the resident had acted lawfully:

He was violently attacked at his own home and responded with justified force. Idaho law presumes that a homeowner acting in defense of their habitation does so with reasonable fear of imminent peril, and my office will not second-guess the fundamental right of self-defense.

It’s great to see such moral clarity.
