A homeowner caught a man breaking into his shed behind his house around five on a Monday afternoon. He confronted him, and the man charged at him with a screwdriver.
The homeowner shot the man in the hand. (Must… not… make “screwdriver to a gunfight” joke…)
Then called the police. Within five minutes of arriving, officers had detained 36-year-old Jose Menjivar less than a block away. He was taken to the hospital for his injury.
It’s worth noting that he wasn’t shot for theft: The homeowner shot him because he charged. In most places, shooting someone for a property crime is itself a crime, so know the law.
Burglary tools turned up at the scene. Lieutenant Sam Boyle of the Sherman Police Department said there was “evidence found that would support the homeowner’s claim,” and added, “We’re not seeing anything that refutes his claim at this point.”
Officers located the homeowner and detectives were called. To this point in our investigation, it appears that the firearms discharge was justified according to state law.
Menjivar was arrested for burglary of a building.
